These terms apply when The Roman Guy, Inc., d/b/a The Tour Guy and The Roman Guy ("TTG"), or a photographer, videographer, or other person working on TTG's behalf, photographs, films, or records me during a tour or activity.

I voluntarily consent to being photographed, filmed, and recorded during the tour or activity.

Participation is optional. Declining consent will not affect my booking, participation in the tour, or the service I receive.

The photographs, video, audio, and other recordings of me are referred to in these Terms as the "Content."

2. Permission to Use the Content

I grant TTG a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, display, distribute, edit, crop, adapt, and incorporate the Content into other materials for TTG's advertising, marketing, promotional, editorial, and informational purposes.

This may include:

TTG websites and mobile applications;
social media;
online and offline advertising;
email marketing;
brochures, travel guides, and other printed materials;
presentations and promotional materials; and
third-party platforms used to advertise or promote TTG's tours and services.

I understand that the Content may be combined with text, graphics, audio, other photographs, or video and that I will not have the right to inspect or approve the final materials before they are published.

TTG will not knowingly use the Content in a false, defamatory, or materially misleading manner.

3. No Compensation

I understand that I will not receive royalties or other payment for TTG's use of the Content unless TTG separately agrees otherwise in writing.

Any gift, discount, complimentary item, or other benefit provided in connection with the photography or filming is a courtesy and does not affect my ability to decline or withdraw consent.

I may withdraw my consent at any time and free of charge by contacting [email protected].

Withdrawal will not affect the lawfulness of any use or processing that occurred before my consent was withdrawn.

After receiving a valid withdrawal request, TTG will stop making new uses of the Content based on my consent and will remove the Content from TTG-controlled digital channels where reasonably practicable.

I understand that TTG may not be able to retrieve or remove Content that has already been:

printed or physically distributed;
incorporated into previously produced materials;
shared, reposted, or copied by third parties;
published on third-party platforms outside TTG's control; or
indexed or cached by search engines or other services.

5. Privacy and Data Protection

TTG may process my image, likeness, voice, and related personal information for the purposes described in these Terms.

Where consent is required under applicable data-protection law, including European, UK, or Swiss data-protection law, my consent is the legal basis for this processing.

TTG may use photographers, marketing agencies, technology providers, social-media platforms, advertising platforms, and other service providers to process, store, publish, or distribute the Content. As a result, the Content may be processed or stored outside the country where the tour takes place, subject to applicable legal requirements.

Nothing in these Terms limits any privacy, consumer, image, publicity, or other rights that cannot legally be waived.

6. Participants Under 18

If I provide consent for a participant under 18 who appears in the Content, I confirm that I am that participant's parent or legal guardian, or otherwise have legal authority to provide consent on their behalf.

7. Governing Law

To the extent permitted by applicable law, these Terms are governed by the laws of the State of New Jersey, United States.

This provision does not limit any mandatory consumer, privacy, data-protection, image, or other legal rights that apply to me under the laws of another jurisdiction.
